By accessing, registering for, subscribing to, or using Fusebyte, you agree to these Terms. If you use Fusebyte on behalf of a company or other legal entity, you represent that you are authorised to bind that entity to these Terms.
3. The Service
Fusebyte is a software platform for marketing operations. It may include planning workflows, execution coordination, asset and task management, AI-assisted features, collaboration tools, usage controls, governance features, billing features, and related functionality.
4. Eligibility and accounts
You must be at least 18 years old and capable of entering a binding agreement. You are responsible for maintaining account credential security, providing accurate information, and activity under your account and workspace.
5. Subscription and billing
- Access to paid features requires an active subscription.
- Subscription details, including plan pricing, included seats, credit allocations, and additional charges, are described on the pricing page and in our Billing & Refund Policy.
- By subscribing, you authorise applicable subscription fees, seat fees, usage-related charges, and applicable taxes.
- Subscriptions renew automatically unless cancelled before renewal.
6. Trials
Trials, pilot access, or limited promotional access may be offered at Fusebyte's discretion and may be limited, modified, or withdrawn at any time.
7. Customer data
You retain ownership of content and data you submit. You grant Fusebyte a limited licence to host, process, transmit, store, reproduce, and use that data as necessary to provide, secure, support, and improve the service, including using aggregated and de-identified information where appropriate. You are responsible for ensuring you have all rights and lawful bases for submitted data.
8. Acceptable use
You must not use Fusebyte for unlawful, fraudulent, harmful, misleading, infringing, malware-distributing, security-disruptive, scraping-abusive, or policy-violating purposes. See our Acceptable Use Policy.
9. AI-assisted features
AI outputs may be incomplete or inaccurate and must be reviewed by users. You remain responsible for decisions made using the service. Fusebyte is not a substitute for professional advice. See our AI Policy.
10. Intellectual property
Fusebyte software, design, branding, and documentation are owned by or licensed to FUSEBYTE LTD. We grant you a limited, non-exclusive, non-transferable right to access and use the service during your subscription term for internal business purposes.
11. Feedback
If you provide feedback, suggestions, or ideas, Fusebyte may use them without restriction or compensation.
12. Third-party services
Fusebyte may integrate with third-party providers. Except as required by law, Fusebyte is not responsible for third-party services.
13. Suspension and termination
Fusebyte may suspend or restrict access for breach, security risk, legal risk, overdue payment, or provider/legal requirements. You may stop using the service at any time. Cancellation and billing consequences are governed by plan terms and the Billing & Refund Policy.
14. Warranties disclaimer
To the fullest extent permitted by law, Fusebyte is provided on an "as is" and "as available" basis without implied warranties.
15. Limitation of liability
Nothing in these Terms excludes liability that cannot lawfully be excluded. To the fullest extent permitted by law, Fusebyte is not liable for indirect, incidental, special, or consequential losses. Aggregate liability is capped at the amounts paid by you in the 12 months before the event giving rise to the claim.
16. Indemnity
You agree to indemnify FUSEBYTE LTD for claims, losses, or costs arising from misuse, breach of these Terms, submitted data, output usage, or infringement-related claims.
17. Force majeure
Fusebyte is not liable for delay or failure caused by events beyond our reasonable control.
18. Changes to service or Terms
Fusebyte may update the service or these Terms from time to time. Where changes are material, we will provide reasonable notice.
19. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer rights where applicable.
